FluentDesk is operated by Tune Up AI Solutions LLC, a Florida limited liability company doing business as Fluent ("we", "us"). This policy explains what information FluentDesk collects, why, and what we do and do not do with it.
FluentDesk answers phone calls that a small business cannot pick up. It texts the caller back, finds out what they need, and passes that on to the business owner. Where a business has connected a calendar, FluentDesk can also book an appointment.
It matters which one you are, because the information involved is different.
For caller information, the business you contacted is the owner of that data. We process it on their behalf and under their instructions.
We do not ask for, and the assistant is instructed not to collect, payment card numbers, government identification numbers, or medical records.
This section applies only to business customers who choose to connect a Google Calendar. Connecting one is optional and can be undone at any time.

In practice FluentDesk only asks Google for busy and free time ranges, using Google's Free/Busy service. That returns start and end times and nothing else.
FluentDesk does not read the titles, descriptions, locations, attendees, attachments, or notes of your existing calendar events. It does not copy your calendar. The only events we can see the contents of are the ones FluentDesk created itself.
Limited Use. FluentDesk's use and transfer of information received from Google APIs to any other app will adhere to the Google API Services User Data Policy, including the Limited Use requirements.
Specifically, we do not use Google Calendar data for advertising, we do not sell it, we do not use it to train generalised artificial intelligence models, and no human at Fluent reads it except where you have asked us to help with a specific problem, where it is needed to investigate a security issue or a fault, or where the law requires it.
A business owner can disconnect their calendar at any time by turning booking off, by emailing us, or directly through their Google Account at myaccount.google.com/permissions. When access is revoked, we stop reading availability immediately and delete the stored access credentials. Appointments already on the calendar stay there; they belong to the business, not to us.
We do not sell personal information, and we never have. We do not use caller conversations or calendar data to train generalised AI models.
FluentDesk uses AI to hold the conversation. Text conversations and voice calls are processed by Anthropic's Claude models, and voice calls are carried by Vapi. These providers process the conversation in order to generate a reply. Under our agreements with them, this content is not used to train their models.
The assistant identifies itself as an AI assistant if a caller asks.
We use a small number of service providers. Each receives only what it needs to do its job.

We may also disclose information where the law requires it, to protect our rights or someone's safety, or as part of a business transfer such as a merger or sale. If that happens, this policy continues to apply to information already collected until you are told otherwise.
If you are a caller and you no longer want texts from a business using FluentDesk, reply STOP to any message. That takes effect immediately and for that business. We keep a record of the opt out so it is not overridden later, including by a booking confirmation.

If a business closes its account, we delete or anonymise its data within 90 days, apart from anything we are required to keep.
FluentDesk runs on servers we control, in Germany, operated by Hetzner. Traffic is encrypted in transit. Access to production systems is limited to the people who need it, and calendar credentials are held separately per business so one business's connection cannot reach another's calendar.
No system is perfectly secure, and we do not claim otherwise. If a breach affects your information we will tell you and the relevant authorities where the law requires it.
Depending on where you live, you may have the right to ask what personal information we hold about you, to have it corrected, to have it deleted, or to object to how it is used. Residents of California and several other US states have these rights under state law.
To make a request, email [email protected]. We will not treat you differently for exercising a right.
If you are a caller, the business you contacted controls that information. We will usually pass your request on to them, and we will help them act on it.
FluentDesk is a tool for businesses and is not directed at children. We do not knowingly collect information from anyone under 13. If you believe a child has given us information, email us and we will delete it.
We are based in the United States and our servers are in Germany, so information is transferred and processed in both. By using FluentDesk you understand that this transfer takes place.
If we change this policy we will update the date at the top. If a change materially affects how we handle personal information, we will tell business customers by email before it takes effect.
